Welcome to Qwego, an online platform that connects clients with expert consultants worldwide for all
your project needs and requirements. By accessing and using our (“Welmun Technologies Inc”)
platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree
to these terms, please do not use our services, and log off from this website. Your use of this website
beyond this is subject to your acceptance of these Terms and Conditions
- Acceptance of Terms
By registering on Qwego or using our services, you confirm that you have read, understood, and agree
to these Terms and Conditions. You represent that you are at least 18 years of age and have the legal
capacity to enter into these terms. If you are representing your corporate entity or company, you agree
that by accepting these terms you have been authorised by your company to do so. - Definitions
Client: A user who posts a project on the Platform seeking the support and services of consultants that
are listed on the Platform.
Consultant: A third-party user registered as a ‘Consultant’ on the Platform, and who offers to provide
their professional services to complete Projects posted by Clients.
Platform: The entire technical and user infrastructure available on qwego.com that
facilitates Clients to post Projects and for Consultants to agree to undertake to complete such Projects.
Projects: A finite set of tasks or actions required to be undertaken by a Consultant as described by the
Client and specified on the Platform (or as may be mutually agreed between the Consultant and the
Client). - User Accounts
Registration: To use the platform, you must create an account. You agree to provide accurate, current,
and complete information during the registration process. You are required to amend these details if
and when these are changed so that they remain updated at all times. We will not be responsible for
any damages that may occur due to updated information not being made available.
Account Security: You are responsible for maintaining the confidentiality of your account credentials
and for all activities that occur under your account. Notify us immediately of any unauthorized use of
your account. - Project Posting and Bidding
Project Posting: Clients may post projects detailing the scope of work, budget, and timeline. These
project descriptions must be sufficiently detailed, include all the relevant information that may be
required by any Consultant to understand the scope of the task, the timelines within which the tasks
need to be completed, and other relevant information that the Platform may require from the Client.
Importantly, please do not provide any confidential information on the description. The Platform will
not be liable for any breach of confidentiality occurring as a result of any confidential information
being provided by the Client or its agents/employees.
Bidding: Consultants can submit proposals in response to Projects, and such proposals will be
available on your dashboard within the Platform
All Project proposals, responses, and communications must at all times comply with applicable laws
and regulations. The Platform will not be responsible for any damages that may arise as a result of the
breach of this clause.
- Project Completion
Clients will have flexibility in specifying whether they would prefer the Project to be completed as a
single project or on a milestone basis. At all times, the Client will have control over assessing the
quality of the work product delivered by the Consultant.
However, once the project is approved by the Client, the Client will have deemed to have approved
the quality of the deliverable and be liable to complete the payment for the Project within the agreed
timelines.
The Project delivery, communication between the Client and the Consultant, and the payment in
respect of the Project will be undertaken solely on the Platform. At no point are either the Client or
the Consultant permitted to discuss or convey any information or communication outside the
Platform. For this purpose, no personal details of either the Client or the Consultant will be shared on
the Platform. - Payment Terms
All payments for the services rendered through the Platform by the Consultants will be processed via
the payment gateway available on the Platform. As the payment gateway is controlled by a third party,
the terms and conditions regarding the payment will be governed by such third-party payment
gateway service provider, and not Qwego. You agree not to circumvent the payment process.
Any fees charged by the Platform will be specified upfront and will be clearly mentioned on the
Platform/dashboard. We will include these fees as additional amounts payable at the time of
completing the payment for the Project. - Ownership of Work Product
Upon completion of a Project, all rights to the work product in respect of a Project completed by the
Consultant will be transferred to the Client upon full payment of all pending dues. It is clarified that
no work product relating to a Project will be delivered unless full payment of all dues has been
received. - Disclaimer
Qwego disclaims any ownership or liability for any work product and any related or ancillary
opinions and advice provided by Consultants. The Client acknowledges and agrees that the Platform
is merely a facilitator between the Client and Consultants, and it in no way is an employer of the
Consultant nor does it direct or manage the Consultant.
All Consultants are freelance service providers on the Platform.
To the fullest extent permitted by law, Qwego shall not be liable for any indirect, incidental, special,
consequential, or punitive damages arising out of or related to these Terms or your use of the
platform.
The services provided by Consultants are done so on an “as-is” basis without any warranties of any
kind including any implicit warranties (all of which are waived herein). Qwego does not guarantee the
quality, accuracy, or completeness of any work product submitted by Consultants. Qwego further
disclaims any endorsement or sponsorship of any Consultant or Project on the Platform.
Qwego shall not be liable for any claims, losses, or damages arising from third-party content hosted
on the platform. This includes but is not limited to claims related to intellectual property infringement,
defamation, or any other legal issues arising from user-generated content.
- Intellectual Property Rights
All content on Qwego, including text, graphics, logos, and software, is owned by or licensed to
Qwego and is protected by applicable intellectual property laws including without limitation,
trademarks, copyrights, service marks, and designs. You are prohibited and restricted from any
reproduction, distribution, or to create derivative works without prior written consent. - User Conduct
Your registration on the Platform acknowledges your confirmation that you will not engage in any
conduct that is harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable while
using our services. - Suspension and Termination of Access
Qwego reserves the right to suspend or terminate your access to the Platform at any time without
notice if you violate these terms or engage in conduct that is harmful to other users or the platform. - Indemnification
You agree to indemnify and hold harmless Qwego, its affiliates, officers, directors, employees, and
agents from any claims or damages (including legal fees) arising out of your use of the Platform or
violation of these Terms. This includes claims related to your projects or work products. - Limitation of Liability Due to External Events
Qwego shall not be liable for any failure to perform its obligations under these Terms due to events
beyond its reasonable control, including but not limited to natural disasters, acts of government, war,
terrorism, riots, or labor disputes. - Changes to Terms
Qwego reserves the right to modify these Terms at any time without prior notice or consent. Any
changes will be posted on this page with an updated effective date and version number. Your
continued use of the platform after changes constitutes acceptance of the new terms and it is your
responsibility to check and update yourself with the appropriate version details. - Data Protection

If any provision of these Terms is found to be unenforceable or invalid by a court of competent
jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the
remaining provisions shall remain in full force and effect. - Governing Law
These Terms shall be governed by and construed in accordance with the laws of the republic of India.
Any disputes arising from these Terms shall be resolved in the courts located in New Delhi.
